The criminal and administrative penalties for a drunk driving conviction are based on the amount of alcohol in your system, known as your blood alcohol concentration (BAC), and they vary depending on any prior DUI arrests and charges you may have.
In Missouri, you can be convicted of DUI in municipal court if:
You have a blood alcohol concentration (BAC) of .08% or higher
You are under the age of 21 and have a BAC level of .02% or higher
You are a commercial driver with a BAC level of .04% or higher
DUI penalties in Missouri
A conviction for DUI can result in the following penalties for a first offense, which is a Class B misdemeanor:
Your license will be suspended for 30 days, followed by a 60-day restricted driving period, if you are 21 years or older. If you are under 21, your license will be suspended for 90 days.
Fines up to $500
Up to six months in jail
Eight points on your driving record
A second DUI offense is a Class A misdemeanor — and you are considered a “prior offender.” Your second DUI offense can result in the following penalties:
License revocation for one year. If this DUI is within five years of a previous one, you receive a five-year license denial.
Fines up to $1,000
Community service of 30 days required for probation
Up to one year in jail, with a minimum of five days served — unless a minimum of 30 days of community service is performed with court approval
12 points on your driving record
Requirement to take and pass both written and driving parts of the Missouri driving test
Ignition interlock device possibly required for one month
A conviction for DUI is a Class D felony and you are considered a “persistent offender.” It can result in the following penalties for subsequent offenses:
Fines up to $5000
License denial for 10 years
12 points on your driving record
Community service for 60 days required for probation
Requirement to take and pass both written and driving parts of the Missouri driving test
Missouri Implied Consent law
Missouri “Implied Consent” law requires you to take a blood, breath or urine test if you are arrested for DUI. Many people do not know their rights under this law in a DUI arrest. The arresting officer should tell you that if you refuse to take the test, your refusal can be used as evidence against you in court and the state will revoke your license. The officer also decides what type of test to administer, but may not administer more than two tests. Once the officer informs you of the decision, you have 20 minutes to consult a DUI attorney about whether you should submit to this test. After you submit to the officer’s test, you have the right to obtain your own body fluid or breath test by a qualified medical professional of your choice. Mr. Kuny can assist on matters regarding refusal.
